Retain Your Residents (1 hr)
Finding the right resident for your practice is a lot of time and work. Protect your investment and keep your resident from straying to other practices by including proper retention provisions in your residency agreements. The basic bargain you make with your resident is simple: you agree to pay all or part of your resident’s training and residency living expenses; and your resident agrees to work at your practice for a minimum period—the “retention period”-- after she is board certified. To implement this bargain, residency provisions typically use a stick and/or carrot approach. This lecture will provide you with some of the basic tools which should be included in your residency agreements.
Specialty Employment Relationships.....Clarify to Avoid Misunderstandings and the Legal Battles That Ensue (2 hours)
Abstract: The importance for specialists to have a clear understanding of their working relationship cannot be overemphasized. Too often disputes and misunderstandings arise because the parties fail to articulate their interests, desires and expectations. This presentation provides a review of the many issues that are salient to an employment relationship, including compensation schemes, benefit packages and buy-in options.
Setting up Specialty Practices....Which Business Structures Work and Don’t Work (1-2 hours)
Business structure is as important as an animal's skeleton.....without it to protect and support vital organs, there is no animal. When specialists come together to develop a practice, they must pay very close attention to their business structure as it will often be the reason for their success or the route to many evils. This presentation provides an overview of various options to structure a specialty business and the legal and business ramifications that go with each.
Shared Lease Arrangements For Specialists (2 hours)
Shared lease arrangements are commonly seen in specialty practice arrangements, and can also be seen when general practice owners which to rent their space at night to emergency practices, thereby maximizing the full potential of their space. In either case, these lease arrangements take on complexities not otherwise seen in typical one party landlord and tenant arrangements. Specifically, these arrangements need to address the sharing of space and operational expenses and costs, such as taxes, utilities, insurance, advertising, supplies, medical and office equipment, staff and liabilities between the parties is no small task. The challenges lie in properly allocating the expenses and responsibilities between the parties to avoid mismatched expectations, hurt feeling and the lawsuits that invariably ensue when business relationships don’t get into the nitty-gritty details.
